1. Agreement to these terms
By accessing or using the Blessy Luxe Investment Limited website, mobile-accessible interfaces, customer dashboard, or staff portal (collectively, the "Platform"), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Platform.
If you use the Platform on behalf of a company or other entity, you represent that you have authority to bind that entity to these terms.
2. Our services
Blessy Luxe provides luxury real estate and vehicle sales information and facilitation services in Kenya, which may include property and car listings, inquiry handling, viewing coordination, house-hunting support, owner and agent tools, and related content. Listing details, availability, pricing, and amenities are provided for informational purposes and may change without notice.
Unless expressly stated in a separate written agreement, nothing on the Platform constitutes a binding offer to sell, lease, or manage a property. Transactions are subject to verification, due diligence, and applicable Kenyan law.
3. Accounts & eligibility
- You must provide accurate, current information when registering or updating your profile.
- You are responsible for safeguarding your password and for all activity under your account.
- Staff, agent, and owner portal access is limited to authorized users. Role selection at sign-in must match your assigned account role.
- We may suspend or terminate accounts that are inactive, inaccurate, abusive, or used in violation of these terms.
4. Acceptable use
You agree not to:
- Use the Platform for unlawful, fraudulent, or misleading purposes.
- Attempt to gain unauthorized access to systems, data, or other users' accounts.
- Scrape, harvest, or systematically copy listings or content without our written permission.
- Upload malicious code, spam, or content that infringes intellectual property or privacy rights.
- Interfere with the Platform's security, integrity, or availability.
- Misrepresent your identity, authority, or interest in a property.
5. Listings, inquiries & viewings
Property information is believed accurate at the time of publication but is not guaranteed. Images, floor areas, amenities, and prices may be approximate. You should independently verify material facts before relying on them for decisions.
Submitting an inquiry or viewing request does not create a brokerage engagement unless confirmed by Blessy Luxe or an authorized agent. We may share relevant inquiry details with assigned agents or property owners to fulfill your request.
6. Fees & third-party services
Platform browsing is generally free. Agency commissions, management fees, deposits, or other charges related to a property transaction (if any) are governed by separate agreements or disclosures provided at the relevant stage. Third-party payment, mapping, or hosting providers may have their own terms.
7. Intellectual property
The Blessy Luxe name, branding, site design, software, and original content are owned by Blessy Luxe Investment Limited or its licensors. You may not copy, modify, distribute, or create derivative works from Platform materials except as expressly permitted for personal, non-commercial use of publicly available listing information, or with our prior written consent.
Property photos and descriptions submitted by owners or agents remain subject to the rights of their respective owners; by submitting content you grant us a license to display and use it to operate and promote the Platform and related services.
8. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that listings will meet your expectations.
Nothing on the Platform constitutes legal, financial, tax, or investment advice. Seek independent professional advice before entering property transactions.
9. Limitation of liability
To the fullest extent permitted by Kenyan law, Blessy Luxe and its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Platform.
Our aggregate liability arising out of or relating to the Platform shall not exceed the greater of (a) fees you paid to us specifically for Platform access in the three months preceding the claim (if any), or (b) Kenya Shillings ten thousand (KES 10,000), except where liability cannot be limited by law.
10. Indemnity
You agree to indemnify and hold harmless Blessy Luxe from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Platform, violation of these terms, or infringement of any third-party right.
11. Suspension & termination
We may suspend or terminate access immediately if we reasonably believe you have breached these terms, pose a security risk, or if required by law. You may stop using the Platform at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, and liability limits) will survive termination.
12. Governing law & disputes
These terms are governed by the laws of Kenya. Courts in Kenya shall have exclusive jurisdiction over disputes arising from these terms or the Platform, subject to any mandatory consumer protections that apply.
13. Changes to these terms
We may revise these Terms & Conditions periodically. The "Last updated" date indicates when changes were last made. Continued use after changes take effect constitutes acceptance where permitted by law. Material changes may be highlighted on the Platform or via account notice when practicable.
